1. Introduction
Welcome to OMIVITA. These Terms and Conditions ("Terms") govern your use of our services and form a binding legal agreement between you and Neurixsoft Technologies, the company that operates OMIVITA. By accessing, registering, browsing, or using our platform, website, mobile application, APIs, healthcare tools, or related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agreed to these Terms.
2. About OMIVITA
Omivita is a digital healthcare technology platform intended to assist users with healthcare-related information, medicine management, health monitoring, analytics, records organisation, and related healthcare support services. Omivita may collaborate with:
- Hospitals, clinics, and diagnostic centres
- Research organisations and pharmaceutical institutions
- Healthcare professionals and academic institutions
- AI and analytics partners
for healthcare improvement, analytics, and medical research purposes.
3. Eligibility
By using the Platform, you confirm that:
- You are at least 18 years old; OR you are using the Platform under supervision of a parent/legal guardian.
- The information provided by you is accurate and lawful.
- You are legally capable of entering into binding agreements under Indian law.
4. User Account Responsibility
Users are responsible for:
- Maintaining confidentiality of login credentials.
- Restricting unauthorized access to their account.
- Ensuring all uploaded information is lawful and accurate.
- Immediately notifying Omivita of any unauthorized access or security breach.
4.1 Family Profiles and Dependent Accounts
Omivita may allow a primary account holder to create, manage, and maintain healthcare profiles for family members, children, dependents, parents, spouses, senior citizens, and other authorized individuals. The primary account holder represents and warrants that they have lawful authority, consent, or guardianship to upload and manage such information. For minors below 18, consent is deemed provided by the parent or lawful guardian. Users are solely responsible for obtaining necessary permissions from family members before uploading or sharing their information.
Omivita shall not independently verify family relationships or guardianship status. The primary account holder accepts responsibility for the accuracy and legality of all submitted information. Omivita shall not be liable for disputes arising between family members regarding uploaded healthcare information.
5. Medical Disclaimer
OMIVITA IS A TECHNOLOGY PLATFORM AND DOES NOT PROVIDE MEDICAL DIAGNOSIS, EMERGENCY MEDICAL SERVICES, OR REPLACEMENT FOR PROFESSIONAL MEDICAL ADVICE.
Users must always consult qualified medical professionals before:
- Starting or stopping any medication
- Changing or ignoring prescribed treatments
- Relying solely on platform-generated recommendations
In emergency situations, immediately contact emergency healthcare services or licensed medical professionals.
6. Device & SMS Access
If you access Omivita through a mobile application, Omivita may request access to device permissions including location, SMS, camera, storage, notifications, and health device integrations. Such permissions are used for medicine reminders, OTP verification, health monitoring, emergency support features, and authentication. Users may disable permissions through device settings; however, certain features may not function properly.
7. User Data Collection
7.1 Personal Information
- Name, email address, mobile number
- Age, gender, address
- Device information and login credentials
7.2 Health and Medical Information
- Medical reports, prescriptions, medicine usage history
- Diagnostic records, symptoms, health conditions
- Doctor recommendations and wellness data
7.3 Technical and Usage Information
- IP address, browser type, device identifiers
- App usage patterns, session analytics, feature interaction history
8. Data Usage and Research Consent
By using Omivita, the User expressly agrees that Omivita may process, analyze, aggregate, anonymize, pseudonymize, and utilize user data for:
- Improving platform services and AI/analytics model training
- Medical research and healthcare trend analysis
- Public health studies and clinical analytics
- Statistical reporting and healthcare innovation
- Academic and institutional research
8.1 Profile Sharing Permission and Doctor Access
Profile sharing is optional and requires your clear, affirmative choice. It is used only to let a doctor locate and view the health profile you select for healthcare-related review, consultation, continuity of care, or record management. Choosing not to share does not prevent you from maintaining records on OMIVITA, although doctor-access features will not work for that profile.
Your permission choices
- Ask Every Time: a doctor request remains pending until you separately approve it. Silence, inactivity, or failure to respond is not approval.
- Grant Automatically: an eligible doctor who finds and adds the selected profile may receive access without another approval prompt. This remains active until you change the policy, revoke that doctor, block the doctor, or close the account.
- A permission applies only to the profile selected when it is granted. Permission for one family member does not authorize access to another family member’s profile.
Information a permitted doctor may access
Depending on the records and features available in the selected profile, access may include identity and contact details, age and gender, health conditions, symptoms, medicines, prescriptions, reports, readings, vaccinations, family or genetic history, pregnancy information, and AI-generated summaries or insights. A doctor receives access only through the Platform and must use it for lawful healthcare purposes and protect its confidentiality.
Revocation, blocking, and prior use
- You may revoke a doctor’s access or change to Ask Every Time through Profile Access Control. OMIVITA will block new Platform access after the change is processed.
- Blocking a doctor prevents that doctor from finding, requesting, or receiving new access to the profile through OMIVITA until unblocked.
- Revocation is prospective. It cannot undo access that lawfully occurred earlier, erase information already relied upon for care, or require deletion of a doctor’s independent clinical records where retention is required or permitted by law.
- Changing the general policy does not necessarily revoke an access grant already given; use Doctor History or Block a Doctor to manage an individual doctor’s existing access.
Your responsibilities
- Share only a profile that belongs to you or a person for whom you have valid authority, consent, or lawful guardianship.
- Confirm the intended doctor’s identity and keep the profile information accurate and current.
- Do not use sharing for an unlawful purpose or upload information that infringes another person’s privacy or rights.
Platform role and important limitations
OMIVITA provides the technical access-control service and maintains security and audit records; it does not direct a doctor’s independent clinical judgment and does not guarantee that a doctor will review shared information, contact you, diagnose a condition, or provide treatment. Profile sharing is not an emergency service and must not replace direct medical attention. To the extent permitted by applicable law, OMIVITA is not responsible for a user’s unauthorized sharing, inaccurate records, a doctor’s independent professional acts or omissions, or copies lawfully retained outside OMIVITA. Nothing in these Terms excludes liability or user rights that cannot legally be excluded.
Consent record and privacy rights
OMIVITA may record the selected profile, permission mode, consent-policy version, date and time, account, device or session information, approvals, denials, access events, revocations, and blocks for security, accountability, dispute handling, and legal compliance. You may withdraw consent as described above and may exercise applicable access, correction, deletion, nomination, and grievance rights through the Platform or by contacting care@omivita.com. Withdrawal does not affect processing already lawfully completed before withdrawal or retention independently required by law.
8.2 Research Sharing
Omivita may share certain user-related medical information with hospitals, research organizations, pharmaceutical companies, and government-recognized healthcare research bodies for legitimate research and healthcare advancement. Where reasonably possible, Omivita shall remove direct personal identifiers and use aggregated or anonymized datasets.
8.3 Artificial Intelligence
Omivita may use AI, machine learning, and predictive analytics to analyze uploaded medical information, generate automated health insights, identify healthcare patterns, and improve clinical support systems. AI-generated outputs are informational in nature and must not be treated as guaranteed medical diagnoses or replacements for licensed medical advice.
9. Applicable Indian Laws
Omivita is designed to support responsible handling under applicable Indian legal obligations, including:
- Digital Personal Data Protection Act, 2023 (DPDP Act)
- Information Technology Act, 2000
- IT (Sensitive Personal Data or Information) Rules, 2011
- Consumer Protection Act, 2019
- Applicable healthcare and telemedicine regulations
10. User Rights
Subject to applicable law, users may request:
- Access to or correction of their personal data
- Account deletion and withdrawal of consent (where legally permissible)
- Data export requests
Omivita may retain certain information where required by law, for fraud prevention, dispute resolution, regulatory compliance, or research records already processed in anonymized form.
11. Intellectual Property
All rights related to Omivita — including logos, branding, software, algorithms, AI models, content, design, and source code — remain the exclusive property of Neurixsoft Technologies or its licensors. Users shall not copy, reverse engineer, reproduce, resell, exploit, modify, or redistribute any part of the Platform without prior written authorization.
12. Prohibited Activities
- Upload false or inaccurate medical information
- Use the Platform unlawfully or for fraudulent purposes
- Attempt unauthorized access or interfere with platform security
- Introduce malware, harmful code, or disrupt service availability
- Violate privacy rights or intellectual property rights of others
- Abuse, harass, or impersonate healthcare professionals or other users
Omivita reserves the right to suspend or permanently terminate accounts violating these Terms without prior notice.
13. Third-Party Services
Omivita may integrate with third-party services including payment gateways, cloud hosting providers, AI systems, communication platforms, and diagnostic services. Omivita is not responsible for third-party outages, external platform errors, or their privacy practices. Users may also be subject to third-party terms and policies when using integrated services.
14. Limitation of Liability
To the maximum extent permitted under applicable law, Omivita, its founders, employees, affiliates, partners, and service providers shall not be liable for medical outcomes, incorrect diagnoses, treatment decisions, loss of data, service interruptions, unauthorized access, indirect, incidental, or consequential damages arising from use of the Platform. Users use the Platform at their own discretion and risk.
15. Indemnification
Users agree to indemnify and hold harmless Omivita and its affiliates from claims, damages, liabilities, costs, and legal expenses arising due to violation of these Terms, misuse of the Platform, violation of applicable laws, infringement of third-party rights, or upload of unlawful or inaccurate content.
16. Data Retention
Omivita may retain user information for regulatory compliance, medical analytics, research continuity, security monitoring, legal obligations, fraud prevention, and audit requirements. Retention periods may vary based on operational, legal, and research requirements.
17. Modifications to Terms
Omivita may modify these Terms periodically. Updated versions shall become effective upon publication on the Platform. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
18. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Gurgaon, Haryana, India.
